We hired him to take our PCR case last year after the State decided to renege on the plea deal and upgrade the charges. He demanded the money be paid in full before taking on the case, refusing to take a payment plan. His initial meeting went on longer than an hour when he said to finish another time. After that, we requested meetings for a period of 8 months before he finally relented. He prepared a brief without even finishing hearing all our issues. He had names and dates consistently wrong and bungled all the issues. He furthermore refused to edit the brief to correct the mistakes. His 2nd draft was identical to his first. He did not listen to a single thing we said. I and my mother independently sent him a list of errors.
He is impossible to get in contact with and does not return phone calls. I asked the secretaries in his office several time for meetings, but rather than schedule them, they tell me that they'll tell him I want a meeting. He does not stay in his office. He is always at court. He will not disclose his cell phone number to anyone.
The court has been postponing court dates for over a year. This last court date, his office did not sent a notice that it was rescheduled, so my father and I each took off work, as well as a witness we had who had personally spoken with Barbone who assured him the court date would indeed happen May 17. His secretary, Theresa, sent an email the previous morning which we did not get until after we had shown up at the court. She then lied and claim she sent it two days before when in fact it had been less than 24 hours. She lied and said she called our home phone, but no message was left on our phone nor was their number listed on our caller id list of most recent callers.
His office is a disaster, especially his negligent secretary. She has been negligent since the day we hired Barbone. We've had notices sent to our old address from since before we hired Barbone. How he even got that address, we don't know aside from a single consultation a year before we hired him. We were lucky that that mail was forward to our current address. We also received notices meant for his other clients, but were instead addressed to us on the envelope.
As for the promises he made to us when we hired him, he has reneged on each one. The main promise that we hired him for was to get the recordings of the trial hearings which the courts have been refusing to hand over. He claimed that they were kept in Trenton and that he could get them even if they weren't part of the trial record. As the courts kept postponing the matter, he told us that it was because the judge was getting the recordings. Then when he finally met us in person at the meeting which took 8 months to schedule, he said that he couldn't get the recordings.

He didn't get the recordings and instead opted to take the states version of events of my objections. At the court hearing, whenever that may be, I plan to challenge Barbone on facts of the case.

This was a blatant lie and a large part of the appeal I filed, the fact that I was promised immediate release from prison under this program by the judge, former defense attorney, and prosecutor. At the very least, Barbone claims, he challenged their false claim. The only issue that I wanted to raise that Barbone raised is this reneging of the ISP.
